By accessing or using AccentCraft Malaysia's AI-powered English learning platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms apply to all users of our platform, including individual learners, corporate subscribers, and trial users. Your continued use of our services constitutes ongoing acceptance of these terms and any updates we may make.

Service Description and Availability

AccentCraft Malaysia provides AI-powered English learning services specifically designed for Malaysian professionals. Our platform includes personalized lesson paths, accent-aware pronunciation training, industry-specific modules, and progress tracking tools.

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service availability. Scheduled maintenance, technical issues, or circumstances beyond our control may temporarily affect service access. We will provide advance notice of planned maintenance when possible.

User Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your account information updated.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with these security obligations.

Subscription Plans and Billing

Our services are offered through various subscription plans with different features and pricing. Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. All fees are non-refundable except as expressly stated in our refund policy.

You authorize us to charge your designated payment method for all applicable fees. If payment fails, we may suspend your access to premium features until payment is resolved. Price changes will be communicated with at least 30 days' notice.

Acceptable Use Guidelines

You agree to use our platform only for lawful purposes and in accordance with these terms. You may not use our services to transmit harmful, offensive, or inappropriate content, attempt to gain unauthorized access to our systems, or interfere with other users' learning experience.

Sharing account credentials, reverse engineering our AI technology, or using our platform for commercial purposes outside your subscription terms is strictly prohibited. Violation of these guidelines may result in account suspension or termination.

Intellectual Property Rights

AccentCraft Malaysia retains all rights, title, and interest in our platform, including our AI technology, learning content, software, and trademarks. Our services are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use our platform for your personal or authorized business learning purposes. You may not copy, modify, distribute, or create derivative works based on our proprietary content or technology.

User-Generated Content and Voice Data

You retain ownership of any content you create or upload to our platform, including voice recordings for pronunciation practice. By using our services, you grant us a license to process, analyze, and use your voice data to provide personalized feedback and improve our AI algorithms.

You represent that any content you provide does not violate third-party rights and that you have the right to grant us the necessary licenses. We reserve the right to remove content that violates these terms or our community guidelines.

AI Technology and Learning Outcomes

Our AI mentor provides personalized feedback and recommendations based on advanced algorithms and your learning patterns. While we strive for accuracy, AI-generated content and feedback should be considered educational guidance rather than definitive assessments.

We do not guarantee specific learning outcomes or proficiency improvements. Your progress depends on various factors including engagement level, practice frequency, and individual learning capabilities. Our platform is designed to support, not replace, comprehensive English learning efforts.

Corporate and Team Subscriptions

Corporate subscribers receive additional features including team management tools, progress reporting, and administrative controls. The primary account holder is responsible for managing team access and ensuring compliance with these terms by all team members.

Corporate accounts must ensure that their use of our platform complies with their organization's policies and applicable employment laws. We are not responsible for disputes between organizations and their employees regarding platform usage.

Certification and Assessment Services

Our certification preparation and hiring assessment features are designed to support learning and evaluation processes. However, we do not guarantee success in external examinations or hiring processes, as these depend on many factors beyond our platform's scope.

Assessment results and progress reports are based on platform interactions and should be considered alongside other evaluation methods. Employers using our assessment tools are responsible for ensuring fair and legal hiring practices.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. Please review our Privacy Policy to understand our data practices.

We comply with applicable data protection laws, including Malaysia's Personal Data Protection Act 2010. You have rights regarding your personal data, which are detailed in our Privacy Policy.

Service Modifications and Termination

Limitation of Liability

To the maximum extent permitted by law, AccentCraft Malaysia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of our services.

Our total liability for any claims related to our services shall not exceed the amount you paid for our services in the twelve months preceding the claim. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

Dispute Resolution and Governing Law

These terms are governed by the laws of Malaysia. Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in Kuala Lumpur, Malaysia, except for claims that may be brought in small claims court.

Force Majeure and Service Interruptions

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, internet service provider failures, or other force majeure events.

In the event of extended service interruptions due to force majeure, we will work to restore services as quickly as possible and may provide service credits or extensions as appropriate under the circumstances.
